Dr. Eddie Hadlock, NCTC President, publicly and repeatedly questioned the integrity of those who successfully challenged the NCTC Bond Election. 
 
On May 16th, in the Gainesville Register, he was quoted as saying: “I hope those who voted no were not misled by some of what I would consider misinformation”. 
 
He was quoted again in the Lindsay Letter dated May 20, 2011:  What I am most disappointed about is that many voters may have been swayed by a lot of misinformation and outright untruths that were put out through the media and other means in the final days leading up to the election.”
 
If Dr. Hadlock was genuinely concerned about the opponents of the bond putting out misleading or inaccurate information about NCTC, why has he been slow, unwilling and/or unable to identify exactly what he thought was misleading??

On May 21, 2011 Ken Arterbury sent a simple Information Request to Dr. Hadlock, NCTC President, asking him to identify what he viewed as misleading or untrue information provided to the voters.

On June 13, 2011, the NCTC Attorneys sent Ken Arterbury some of the responsive documents via certified mail and included a letter to the Attorney General asking that they be allowed to withhold some of the requested information, apparently with a consultant they hired with taxpayer dollars to advise the college on the likelihood of success on a bond election.

So what did we find out?  We learned Dr. Hadlock sent an e-mail out to all employees asking for volunteers and says yard signs will be in his office for people to put in their yards and their neighbors.  Does State Law allow Dr. Hadlock to use college e-mail and resources for campaign purposes and advocating for the bond??

Texas Election Code 255.003 UNLAWFUL USE OF PUBLIC FUNDS FOR POLITICAL ADVERTISING

It has yet to be determined whether any crimes were committed under Texas Election Code 255.003.  The Texas Ethics Commission is currently conducting an investigation. 

What is the penalty for being guilty of a Class A Misdemeanor?  According to Texas Penal Code Section 12.21:

Sec. 12.21.  CLASS A MISDEMEANOR.

An individual adjudged guilty of a Class A misdemeanor shall be punished by:

   (1)  a fine not to exceed $4,000;

   (2)  confinement in jail for a term not to exceed one year; or

   (3)  both such fine and confinement.

On August 8, 2011, NCTC's law firm finally sent Ken Arterbury three documents they felt were misleading or untrue.  
 
A Letter to the Editor from Stephen Harlow.  While Dr. Hadlock didn't identify any discrepancies, we agree the statement about no difference between in-county and out-of-county tuition was wrong.  There remains a difference.  We did not see this letter before it appeared in the newspaper.
 
There was also an anonymous letter that Dr. Hadlock at the last board meeting said he objected to it because it stated "HADLOCK AND OBAMA...TWO PEAS FROM THE SAME POD". Note: We at Cooke Citizens had not seen this letter before it was provided to us by the college.  We do not support anonymous political letters consistent with Texas Law.  We are only providing it here as information as to what Dr. Hadlock was referring to as misleading and untrue.
 
Finally, the attorney provided a copy of the front page bar chart ad run by Steve Gaylord the day before the election showing the true cost per credit hour including taxes per credit hour.  I would note that Steve Gaylord has presented this analysis since 2004.  In 2008, he ran an ad offering $500 to anyone that could prove he was wrong or that he had knowingly written anything misleading about the college.  TO date, no one has taken Steve Gaylord up on that offer.
 
Since no other documents, ads or e-mails circulated before the election were provided by the college, we presume that Dr. Hadlock did not find the other ads, Letters to the Editor, and e-mails misleading or otherwise didn't see them.

Based on an analysis the college provided Ken Arterbury, the college only wants to add the average taxes paid for a house in Cooke County while the student is attending NCTC to the student tuition to show they think it is a bargain.  The problem with that analysis is it ignores the large majority of households in Cooke County that continue to pay taxes every year to NCTC but don't have a student enrolled at NCTC.  A copy of that analysis will be linked below.
