Dear Cooke County Voter:

 

            A recent mailing by an opponent contained numerous false and misleading statements regarding the record of the District Attorney’s Office.  Cases were cited as being dismissed when in reality there was no longer a witness available in the case (those cases can be brought again if the victims and their families decide to cooperate with the State in the future).  In one case the opponent attacks the office for dismissing a case when the truth is that the Defendant is serving a 55 year sentence.  There is even an attack for dismissing cases in general.  There are any number of reasons why an indictment can be dismissed, such as, a simple correction in the first indictment.  Cooke County has a dismissal rate that is less than the State average.

 

            Janice Warder, candidate for Cooke County District Attorney, will be under oath in the courtroom of Dallas County District Judge Mike Snipes Wednesday, February 27th being accused of prosecutorial misconduct in the case of the wrongful life sentence of Clay Chabot which Warder obtained using perjured testimony of the real rapist.  Warder reduced a murder charge to a misdemeanor against a man who raped a woman.  The woman was then shot in the head and murdered in her own home.  DNA has recently shown that two capital murder cases will have to be retried because of her conduct.  The three day hearing is to be held February 27-29. She is also accused of cutting a deal with witnesses she wrongfully did not disclose to the defense and withholding other evidence from the defense.  And she testified in a federal hearing that her affidavit regarding the deal made with the real rapist was false.  This is a matter of public safety for the citizens of Cooke County.  It will be covered by the Dallas Morning News.

 

            The Citizens of Cooke County should be very proud of the accomplishments that have been produced by the hard work of the District  Attorney's Office in the past three years.  We have disposed of over 1600 felony cases in the three years I have been District Attorney.  I am more than happy to discuss any of those cases with anyone and explain why a result was  reached in a specific case. Before anyone is punished for a crime, any type  of crime, there must be credible, admissible proof sufficient to show the  alleged conduct beyond a reasonable doubt to the unanimous satisfaction of 12 jurors.  I do not choose to prosecute cases which do not have any reasonable chance of success in the courtroom. 

 

            There has been a forty-eight  per cent increase in sentences to the penitentiary (on average each year)  since January 2005 when I took office.  We are disposing of an average of 200 more cases per  year than previously.  The results are less crime, less meth labs, less violent crime, fewer felons on bond awaiting trial, . .We have obtained harsher sentences and less probations than other similarly situated counties.  For verification of this and more information please visit my website at  www.cstormer.com
